103年3月18日，反服貿學生衝進立法院佔領watch議場，抗議服貿法案倉促過關，開始24天太陽花學運。事後台北地檢署依違反《集會遊行法》、煽惑犯罪、妨害公務等罪起訴黃國昌、林飛帆、陳為廷、魏揚等22人。北院31日宣判22名被告全部判無罪，全案仍可上訴。

被起訴煽惑他人犯罪共9人，包括黃國昌、周馥儀、黃郁芬、陳為廷、魏揚、林飛帆、曾柏瑜、陳廷豪、蔡丁貴；妨害公務罪4人，包括林飛帆、賴品妤、林楷翔、李惠仁；違反《集會遊行法》只有蔡丁貴；聚眾妨害公務罪共9人，包括蔡丁貴、李夙儒、黃國陽、許順治、王溪河、王文斌、陳建斌、莊程洋、余能生；侮辱公署罪共3人，包括蔡丁貴、吳灃洪、賴富榮。

對此，當初參與318學運，現在已進入國會的時代力量立委黃國昌表示，這個判決，從憲政民主的高度，肯認了公民精神與行動，感謝所有參與的夥伴與支持的朋友，也感謝過去兩年多來，在法庭上不斷闡述這個運動所具有憲政意義的義務律師團，接下來，也請大家共同關注、共同支持323行動與411行動的司法審判。

為何這次22人全無罪？北院行政庭長廖建瑜指出，此次判決的主要依據為「公民不服從」，北院審酌後，認為本案符合此概念，因此不具實質的違法性。

廖建瑜說，「公民不服從」的概念，包括抗議對象是與政府或公眾事務有關的重大違法或不義行為、基於關切公共利益或公眾事務目的、抗議行為須與抗議對象間具有可得認識的關聯性、須為公開及非暴力行為，且須符合適當性、必要性、狹義比例原則。
